5. You agree to fully indemnify www.designawardagency.com and its sponsors in respect of all costs owing to any person or entity arising by reason of your breaching any of the foregoing.
6. Please do not submit any photos or content that are obscene, vulgar, pornographic, hateful, threatening, racist, sexist, discriminatory, or which otherwise violate any local or international laws.
7. You are the only author of your work and that it is your original work.
8. You are the sole copyright holder.
9. You have not licensed any rights in the work that will conflict with the usage rights required by DAA - Design Award Agency on www.designawardagency.com website.
10. You have permission from the owners of property shown in the work to grant the usage rights required by DAA - Design Award Agency on www.designawardagency.com website.
11. That it does not include trademarks, contract rights, or any other intellectual property rights of any other third person or entity.
12. You will be responsible for any claim made by any third party in respect of your submitted materials and to fully indemnify DAA - Design Award Agency on www.designawardagency.com website and its sponsors in respect of all royalties, fees and any other monies owing to any person or entity by reason of your breaching any of the foregoing.
A) This agreement is made between

DAA - Design Award Agency which is the sole owner of the www.designawardagency.com website (here in after DAA); and,
Advertiser has registered to the DAA website and submit his/her Design Award, Design Competition, Design Contest (here in after Award),
or
Designer has registered to the DAA website: www.designawardagency.com (here in after DAA website) and submit his/her Profile and Portfolio (here in after Portfolio).

B) Acceptance
​
Advertiser and Designer hereby agrees the terms of this agreement by submitting his/her Award and Portfolio to DAA website.
​
C) The Subject of The Agreement
​
Within the scope of this agreement, the Advertiser and Designer shall submit his/her Award and Portfolio to the DAA website in accordance with the terms and conditions situated in this agreement so as to use the marketing services. DAA shall have right to use the submitted Awards and Portfolios for promotional efforts on DAA’s websites, DAA's instagram page and DAA's facebook page. DAA shall have right to use the submitted Awards and Portfolios to communicate to the public. Advertiser or Designer shall accept and declare to give the right of usage of the submitted Award and Portfolio and it accept not to put in a claim for using of the Award and Portfolio within the scope of promoting and advertising. The scope of use of the rights granted under this agreement is limited only to the promotion and advertisement of Award and Portfolio.

D) The Duration of the Agreement
​
This agreement shall be in force from the date of submitting of the Award by the Advertiser and Portfolio by the Designer. Advertiser and Designer shall accept and agree that DAA shall have right to use the Award and Portfolio, right of adaptation (process) , right of reproduction, right to communicate a work to public by devices enabling the transmission of signs and/or images including the digital transmission, related to the Award and Portfolio and other rights designated in this agreement without any limitation regarding location, number and content, and within the scope of promoting and advertising.

E) The Obligations of the Competitor and Designer
​
Submitted Award by the Advertiser and submitted Portfolio by the Designer shall not violate any third party rights and DAA shall not be considered as responsible. In case of that DAA is pushed to make a payment to the third parties due to the violation of their rights, Advertiser and Designer shall accept, declare and undertake to compensate the all losses and damages of DAA. Awards and Portfolios submitted to the DAA's website shall contain the relevant and correct information. Advertisor and Designer shall declare and undertake that submitted Award and Portfolio is the Advertiser's and Designer's work.

F) The Rights of the DAA - Design Award Agency
​
Advertiser and Designer agrees to undertake the license non-exclusively to DAA the right to use his/her Award and Portfolio, within the scope of promoting and advertising for DAA website. Advertiser and Designer agrees and undertakes that DAA shall have right to reproduce and publish the original or copies of the Advertisor's and Designer's submitted materials in any form or by any method, with all kinds of print techniques or in different formats through electronic methods, in physical or electronic media. DAA may reproduce and publish the Awards and Portfolios in physical media and transmit these to its subscribers. Copyrights remain on the Advertiser and Designer, he/she shall give DAA right to use the submitted Award and Portfolio with Advertiser’s and Designer's credit.

G) Submission categories
​
There are 2 submission categories in DAA website: submit award and submit portfolio. Advertiser shall use "Submit Your Award" menu to submit his/her Award. Designer shall use "Submit Your Portfolio" menu to submit his/her Portfolio.
H) Submission steps for Advertisers
1. Please, visit the Advertise page and order and choose a marketing package that's right for you: Essentials, Premium, Elite.
2. We are going to send your DAA ID number within 72 hours after your payment by e-mail.
3. After you recieved your DAA ID number you can Submit your Award & Competition.
4. Your Portfolio or Award & Competition will be published on DAA's website within 72 hours.
5. You will receive the extra benefits included the marketing packages after your submission was published.

After a validation process, Advertiser's submitted Award is going to published on DAA website within 72 hours. Submitted and approved Awards will apply in the "Awards & Competitions" menu.
Designers are able to submit their Portfolio after purchase one of the marketing packages: Essentials, Premium, Elite. After a validation process, Designer's submitted Portfolio is going to published on DAA website within 72 hours. Submitted and approved Portfolios will apply in the "Designers" menu.

M) Limits
Advertiser and Designer can enter as many registrations, submissions and advertisement orders as he/she like. There are no limits about the number of submitted Awards and Portfolios.
N) Process of accept Awards and Portfolios
All submissions will be carefully evaluated by the members of DAA Team. They shall evaluate and check all the submitted Awards and Portfolios for the following aspects: quality, technical adequacy, authentication of the materials. Advertiser and Designer shall not have any right to make an objection to the decisions given by the DAA Team. After a validation process, Advertiser's submitted Award is going to published on DAA website within 48 hours. Submitted and approved Awards will apply in the "Search Awards" menu. Advertiser can advertise his/her submitted Award on DAA website for a fee. After a validation process, Designer's submitted Portfolio is going to published on DAA website within 48 hours. Submitted and approved Portfolios will apply in the "Find Designers" menu. Designer can advertise his/her submitted Portfolio on DAA website for a fee.
O) Termination

DAA have right to terminate this agreement anytime without giving any reason and notice.
P) DAA website Terms of Use

All content in DAA website is protected by international and national copyright law. All Advertisers and Designers displayed in this website belongs to the copyright owners. DAA cannot be held responsible by third parties, because of the damages arising from the submitted materials on DAA website.
